Terms of service
1. Provider and scope
Swiftfunnel is a software-as-a-service offering of SINISTAR MEDIA, owner Phil Sievers, Zum Morgenland 2, 21376 Eyendorf, Germany. These terms apply to the platform and optional connected services such as WhatsApp Cloud API. Individual agreements take precedence.
Customers must be businesses within Section 14 BGB. The service is not offered to consumers within Section 13 BGB.
2. Accounts and permissions
Users must provide accurate information and protect credentials. Workspace owners may grant access only to authorised people. Meta or WhatsApp accounts may only be connected by a person authorised to manage them and grant the displayed permissions.
3. Permitted use
Use must comply with law, third-party rights and applicable provider policies. Spam, deception, unlawful content, unauthorised processing of personal data and attempts to bypass security or usage limits are prohibited.
4. Meta and WhatsApp
Messages may only be sent where the required consent or other legal basis exists. Outside WhatsApp’s customer-service window, only Meta-approved templates may be used. Meta independently operates the Cloud API; availability, approvals, quality ratings, limits and Meta fees are outside Swiftfunnel’s control.
5. Content and responsibility
Customers remain responsible for funnel content, recipient lists, consent, privacy notices and messages. They grant Swiftfunnel the rights required to provide the service technically.
6. Availability and changes
We operate Swiftfunnel with reasonable care but cannot guarantee uninterrupted availability. Maintenance, security measures or external API changes may temporarily restrict features. Material changes are announced appropriately where possible and required.
7. Prices, term and payment
Public prices exclude statutory VAT. Monthly plans bill monthly and annual plans twelve months in advance through Stripe. After the one-time seven-day trial, the subscription renews for the selected billing period unless cancelled beforehand in Stripe’s customer portal.
There is no statutory consumer withdrawal right because contracts are exclusively with businesses. If payment fails, a seven-calendar-day grace period applies. After that, platform access may be suspended and published funnels may be taken offline until payment is settled; stored data is not automatically deleted.
8. Disconnecting and suspension
Meta or WhatsApp accounts can be disconnected in workspace settings. We may suspend access or individual features for material breaches, security risks or legal obligations.
